And there is a significant and long-awaited reform step: the <strong><br \/>\n  <a href=\"https:\/\/commission.europa.eu\/index_it\">European Commission<\/a><br \/>\n<\/strong> has committed to <strong>stepping up monitoring of how data protection authorities at the level of EU member states apply the bloc&#8217;s flagship data protection rules<\/strong>, committing to regular audits of <em>&#8220;large-scale&#8221;<\/em> cases of the General Data Protection Regulation (GDPR). Controls that could help address long-standing criticism that<strong> GDPR<\/strong> enforcement is too weak and laborious to put meaningful controls on <strong>Big Tech<\/strong>.<\/p>\n<\/div><\/div>\n<div class=\"et_pb_module et_pb_cta_578 et_pb_promo  et_pb_text_align_center et_pb_bg_layout_light\">\n<div class=\"et_pb_promo_description et_multi_view_hidden\"><\/div>\n<div class=\"et_pb_button_wrapper\"><a class=\"et_pb_button et_pb_promo_button\" href=\"https:\/\/temp_new.vmenginelab.com\/en\/2022\/02\/28\/data-protection-europe-approves-code-of-conduct-on-cloud-services\/\" target=\"_blank\">Data Protection, Europe approves Code of Conduct on Cloud Services<\/a><\/div>\n<\/p><\/div>\n<div class=\"et_pb_module et_pb_image et_pb_image_601 et_animated et-waypoint\">\n<p>\t\t\t\t<span class=\"et_pb_image_wrap \"><img decoding=\"async\" src=\"http:\/\/temp_new.vmenginelab.com\/wp-content\/uploads\/2023\/02\/security-alert-on-smartphone-screen-antivirus-war-2022-11-14-12-02-54-utc-1-2.jpg\" alt=\"\" title=\"security-alert-on-smartphone-screen-antivirus-war-2022-11-14-12-02-54-utc (1)\"  sizes=\"(max-width: 740px) 100vw, 740px\" class=\"wp-image-35820\" \/><\/span>\n\t\t\t<\/div>\n<div class=\"et_pb_module et_pb_text et_pb_text_2166  et_pb_text_align_left et_pb_bg_layout_light\">\n<div class=\"et_pb_text_inner\">\n<p>Privacy<strong> and data processing violations<\/strong>, under the umbrella of the European GDPR legislation, in 2022 showed that two new fronts have opened up. The first is with the United States. After a regulatory vacuum was created <strong>in July 2020<\/strong>, after the &#8220;Schrems II&#8221; ruling of <strong><a href=\"https:\/\/curia.europa.eu\/jcms\/jcms\/j_6\/it\/\">the Court of Justice of the European Union<\/a> <\/strong>that<strong> invalidated the Privacy Shield in force between the United States and the European Union<\/strong>, the<strong> Biden<\/strong> administration is trying to create an <strong>alternative regulation for the transfer of personal data across the Atlantic<\/strong>. The <strong><br \/>\n  <a href=\"https:\/\/european-union.europa.eu\/index_it\">European Union <\/a><br \/>\n<\/strong>is therefore proceeding on a similar path and a first agreement has been reached, but in the long term, according to the lawyers, it is not clear whether the new operational decisions taken by the United States and the European Union will be sufficient or there will be <strong>a risk of a new ruling that nullifies the validity of the agreements<\/strong>.<\/p>\n<\/div><\/div>\n<div class=\"et_pb_module et_pb_text et_pb_text_2167  et_pb_text_align_left et_pb_bg_layout_light\">\n<div class=\"et_pb_text_inner\">\n<p><strong>The EU executive<\/strong> responded to its ombudsman by saying that <strong>it will ask all national data protection supervisory authorities to share a report on a bi-monthly basis<\/strong>, presumably every two months instead of twice a month, so six times a year. In short, an overview of large-scale cross-border investigations under the GDPR. In addition, <em>the Commission establishes that these reports will have to include various key details such as the case number, the controller or processor involved, the type of investigation<\/em>. All together with a summary of the scope of the investigation including the provisions of the GDPR in question.<\/p>\n<\/div><\/div>\n<div class=\"et_pb_module et_pb_image et_pb_image_602 et_animated et-waypoint\">\n<p>\t\t\t\t<span class=\"et_pb_image_wrap \"><img decoding=\"async\" src=\"http:\/\/temp_new.vmenginelab.com\/wp-content\/uploads\/2023\/02\/italy-and-european-union-flags-2.jpg\" alt=\"\" title=\"Italy and European Union Flags on the Venetian Style Building.\"  sizes=\"(max-width: 740px) 100vw, 740px\" class=\"wp-image-35822\" \/><\/span>\n\t\t\t<\/div>\n<div class=\"et_pb_module et_pb_cta_579 et_pb_promo  et_pb_text_align_center et_pb_bg_layout_light\">\n<div class=\"et_pb_promo_description et_multi_view_hidden\"><\/div>\n<div class=\"et_pb_button_wrapper\"><a class=\"et_pb_button et_pb_promo_button\" href=\"https:\/\/temp_new.vmenginelab.com\/2021\/09\/21\/protezione-e-controllo-dei-dati-limpegno-di-aws-verso-i-clienti-europei\/\" target=\"_blank\">Data Protection and Control, AWS&amp;apos; Commitment to European Customers<\/a><\/div>\n<\/p><\/div>\n<div class=\"et_pb_module et_pb_text et_pb_text_2168  et_pb_text_align_left et_pb_bg_layout_light\">\n<div class=\"et_pb_text_inner\">\n<p><strong>The European executive<\/strong> <strong>has also committed<\/strong>, in its second forthcoming report on the application of the GDPR, <strong>to provide an account of the information it receives from data protection authorities<\/strong>. Then <em>the Commission will report on the reporting of the data protection authorities<\/em>. There is also an old complaint requesting the suspension of <strong><br \/>\n  <a href=\"https:\/\/about.meta.com\/\">Facebook<\/a><br \/>\n<\/strong> data exports. While <strong><a href=\"https:\/\/www.apple.com\/it\/\">Apple<\/a><\/p>\n<p><\/strong>, <strong><a href=\"https:\/\/twitter.com\/\">Twitter<\/a><\/strong>, and <strong><a href=\"https:\/\/www.tiktok.com\/\">TikTok<\/a><\/p>\n<p><\/strong> all have <strong>GDPR<\/strong> cases open awaiting decisions, in some cases years after an investigation has been opened.<\/p>\n<\/div><\/div>\n<div class=\"et_pb_module et_pb_text et_pb_text_2169  et_pb_text_align_left et_pb_bg_layout_light\">\n<div class=\"et_pb_text_inner\">\n<p><strong>Privacy activists and legal experts in the EU<\/strong> have argued for years that, on paper,<strong> the GDPR should protect consumers from tracking<\/strong>. Yet they also pointed out that these same rules are <strong>being systematically violated by tech giants<\/strong> who think they are big enough to ignore them. The result is that <strong>European citizens&#8217; rights are crushed by the market muscle of major tech platforms<\/strong> and their associated operator ecosystems, which critics say extend to the regulatory takeover of <em>&#8220;friendly&#8221; DPAs<\/em>. A year in which the total amount of fines imposed for GDPR violations on the big tech companies and beyond from 28 January to date has been equal to the record figure of 1.64 billion euros, with an increase of 50% compared to the previous year, which brings the <strong>GDPR fines made since 25 May 2018 to the total of 2.92 billion euros<\/strong>.
